This Privacy Policy explains how Vibe LeadStack collects, uses, discloses, and protects personal information when you visit our website, contact us, book an appointment, make a payment, receive communications from us, or use our services.

This Privacy Policy applies to personal information handled by Orange Monkey Studios LLC, doing business as Vibe LeadStack (collectively, "Vibe LeadStack," "we," "us," or "our"), through vibeleadstack.com and related forms, booking pages, payment pages, communications, and services directed to users in the United States.

When we process personal information contained in a customer's customer relationship management system, lead database, campaign, form, or other account solely on that customer's behalf, we generally act as a service provider or processor. In that situation, the customer's privacy policy and instructions govern the customer's collection and use of the information, and requests concerning that information should ordinarily be directed to the customer first.

This Privacy Policy does not apply to third-party websites, applications, or services that we do not control.

Information You Provide

We may collect information you provide when you complete a form, request information, schedule an appointment, communicate with us, enroll in email or text communications, purchase services, or otherwise interact with us. This information may include:

• Identifiers and contact information, such as your name, business name, email address, telephone number, and mailing address.

• Inquiry and appointment information, such as the services you are interested in, scheduling details, project information, and the contents of messages you send us.

When you use our website, we and our service providers may automatically collect device and usage information, including your IP address, browser type, device type, operating system, referring pages, pages viewed, links clicked, approximate location derived from an IP address, timestamps, and interactions with advertisements or website features.

Information Processed for Customers

In providing lead-management, automation, website, funnel, scheduling, messaging, or related services, we may process information supplied or collected by our business customers. This may include contact records, lead information, appointment details, form submissions, communication history, campaign data, consent records, and other information placed in a customer's systems. We process this information to provide, secure, maintain, support, and improve the contracted services and as otherwise permitted by our agreement with the customer.

3. How We Use Personal Information

We may use personal information to:

Respond to inquiries, provide consultations, schedule appointments, and communicate about requested services.

• Provide, configure, maintain, support, and improve our websites, funnels, CRM systems, automations, campaigns, and related services.

• Process payments, send invoices or receipts, and administer transactions.

• Send administrative, transactional, service, email-marketing, or SMS communications consistent with your choices and applicable law.

• Personalize content, understand website use, measure campaign performance, and improve our marketing and business operations.

• Government authorities or other parties when disclosure is required by law or reasonably necessary to protect rights, safety, property, or the integrity of our services.

• Other parties at your direction or with your consent.

Certain state privacy laws may treat some uses of advertising cookies or pixels as a disclosure for targeted advertising. Where applicable, you may exercise the rights described in Section 11.

If you choose to receive marketing emails, we may send information about our services, offers, resources, or business updates. You may unsubscribe by using the link included in a marketing email or by contacting us at [email protected]. We may continue to send non-marketing messages that are necessary to provide requested services, complete transactions, respond to you, or administer our relationship.

6. SMS and Mobile Information

We may send text messages only as permitted by your consent and applicable law. Message frequency may vary. Message and data rates may apply. You may reply STOP to opt out and HELP for assistance. Consent to receive marketing text messages is not a condition of purchasing goods or services.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may use cookies and similar technologies to operate the website, remember preferences, understand traffic and visitor behavior, evaluate the effectiveness of our marketing, detect problems, and deliver or measure advertising.

Meta Pixel may help us measure advertising performance, build audiences, and understand actions taken after an advertisement is viewed or selected. Payments may be processed by Stripe or another payment processor. Payment processors collect and process payment card and related transaction information under their own terms and privacy notices. Vibe LeadStack may receive transaction confirmations, billing contact information, payment status, and limited transaction details, but we do not intend to receive or store full payment-card numbers.

9. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, provide services, maintain business and consent records, comply with legal, tax, accounting, and reporting obligations, resolve disputes, enforce agreements, and protect our business. Retention periods vary based on the type of information, the nature of our relationship, customer instructions, and applicable legal requirements. We may retain deidentified or aggregated information that cannot reasonably be linked to an individual.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for using appropriate security practices for accounts and systems under your control and for notifying us if you suspect unauthorized activity involving our services.

If we process the information solely for one of our customers, we may direct the request to that customer or assist the customer in responding.

If we deny a request and applicable law provides a right to appeal, you may appeal by replying to our decision or emailing [email protected] with the subject line "Privacy Appeal."

12. Do Not Track

Some browsers offer a "Do Not Track" setting. Because there is not a uniform industry standard for responding to these signals, our website may not respond to traditional Do Not Track signals. We address legally recognized opt-out preference signals as described in Section 7.

13. Children's Privacy

Our website and services are intended for businesses and adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13.
